Court Adjourns ADC Leadership Suit Indefinitely Amid Transfer Request Controversy

The Federal High Court in Abuja has again adjourned indefinitely a suit challenging the leadership of the African Democratic Congress, ADC, under former Senate President David Mark.

Justice Emeka Nwite postponed the matter on Friday after the plaintiff, Nafiu Bala Gombe, informed the court that he had requested the Chief Judge of the Federal High Court to transfer the case to another judge.

Counsel to the plaintiff, Luka Musa Haruna, told the court that the Supreme Court had, on April 30, dismissed an interlocutory appeal filed by David Mark against the proceedings, describing the appeal as lacking merit.

He added that the apex court also set aside an earlier order of the Court of Appeal which had stayed proceedings in the substantive suit.

Haruna, however, informed the court that the plaintiff had written to the Chief Judge on May 4, seeking reassignment of the case, and urged Justice Nwite to await the administrative decision on the request.

Lawyers representing the defendants opposed the application, accusing the plaintiff of attempting to delay the accelerated hearing earlier ordered by the Court of Appeal and upheld by the Supreme Court.
